User Agreement

This User Agreement is a legally enforceable contract between you and JustPush, ("JustPush"), setting out the terms under which you may utilise the services provided by JustPush.

Contract Formation

By accessing and utilising the JustPush.net website ('Service') or any services

offered by JustPush, you consent to adhere to the terms and conditions outlined in the User Agreement.

Account Terms

  1. This Service is available for use only by individuals who are at least 13 years old.
  2. During the registration process, you are required to supply a valid email address and any other necessary information to complete the signup.
  3. Each account, identified by an email address and a One-Time-Password (your "login") is intended for use by a single individual only.
  4. It is your responsibility to ensure the security of your password. JustPush is not responsible for any losses or damages resulting from your inability to safeguard your account and password.
  5. You are prohibited from sending unsolicited emails, SMS, or "spam" messages using JustPush’s platform, unless explicitly mentioned. In example, due to a specific activated package or subscription.
  6. Do not disseminate any worms, viruses, or harmful code through the Service.
  7. The use of the Service for illegal or unauthorised purposes is strictly forbidden and will result in immediate account cancellation and termination of your services.
  8. You must not replicate, duplicate, sell, resell, or exploit any part of the Service, its use, or access to the Service without JustPush's explicit written consent.
  9. Any violation of these Account Terms, as judged solely by JustPush, will lead to the immediate termination of your services.

Don't send spam, spread viruses, or use the service for illegal activities. Doing anything against these rules, like reselling the service without permission, could lead to your account being terminate.

General

  1. Before you can join the Service, it's mandatory for you to thoroughly read, agree to, and accept all the terms and conditions specified in this User Agreement.
  2. We maintain the right to alter or discontinue the Service at any given moment for any reason, and this may be done without prior notification.
  3. At our discretion, we may refuse service to any individual at any time for any reason.
  4. Utilising the Service is entirely at your own risk. The Service is offered "as is" and "as available," without any form of warranty, whether express, implied, or under law.
  5. JustPush does not guarantee that the Service will be continuous, timely, secure, or free from errors.
  6. JustPush makes no promises regarding the accuracy or reliability of the outcomes that might be achieved from using the Service.
  7. Technical support is offered solely on an effort-based basis and is accessible only through email and designated support forums.
  8. Be aware that JustPush relies on external vendors and hosting partners to supply the necessary hardware, software, networking, storage, and other technology required for the Service.
  9. We reserve the right to delete any content or accounts containing material that we, in our sole discretion, deem illegal, offensive, threatening, libelous, defamatory, obscene, or in violation of someone's intellectual property rights or these Terms of Service.
  10. JustPush does not assure that (i) the Service will meet your specific needs, (ii) the Service will be uninterrupted, timely, secure, or error-free, (iii) the results from using the Service will be accurate or reliable, (iv) the quality of any products, services, information, or other materials obtained by you through the Service will meet your expectations, and (v) any Service errors will be corrected.
  11. You acknowledge and agree that JustPush, including its affiliates, officers, directors, and employees, shall not be liable for any kinds of direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to damages for lost profits, goodwill, use, data or other intangible losses (even if JustPush has been advised of the possibility of such damages), arising from: (i) your use or inability to use the Service; (ii) costs incurred for substitute goods and services resulting from any goods, data, information, or services bought or obtained, messages received, or transactions entered into via or from the Service.
  12. All fees are exclusive of all taxes, levies, or duties imposed by tax authorities. You are responsible for paying all such taxes, levies, or duties, with the exception of only United States (federal or state) taxes.
  13. If you have used a promotional code for a discounted account, be aware that upgrading or downgrading this account will result in the immediate loss of this discount for future charges.
  14. Cancelling your Service will lead to the removal of all your Content from the Service.

Before using our service, you must agree and have read our terms. We can change or stop the service anytime, deny service to anyone, and don't guarantee the service will always work as expected. There's no promise of performance or reliability, and all use is at your own risk. JustPush isn't liable for any damages or losses from using the service. You're on the hook for any taxes related to the service, except for certain U.S. taxes. Using promo codes might affect pricing on account changes, and canceling means your content gets deleted.

Limitations and restrictions

  1. To ensure the Service's highest quality and accessibility, JustPush implements prudent limits on the frequency of message transmission through our API, email servers, web servers and third-party providers.
  2. There is no cap on the number of messages or notifications a Service user can receive, provided that the message frequency remains reasonable and does not compromise the Service's quality or efficiency.
  3. Message dispatch via the JustPush API(s) is restricted to registered applications ("sources") that have been granted an API token. Each source is allocated a specific number of messages they can send each month, as detailed on the JustPush website. This allocation can be increased for each source either on a one-off or recurring basis, also via the JustPush website.
  4. A single API token is assigned to each unique source, and the use of multiple API tokens to bypass JustPush's rate or volume restrictions is prohibited.
  5. API tokens are personal and cannot be shared or registered for use by other Service users.
  6. JustPush retains the right to terminate the service of any user who attempts to bypass these established limitations.

Simplified

We limit message sending to ensure good service. Sending messages are okay if they don't harm service quality. Each app needs an API token to send a fixed number of messages monthly, which can be increased if necessary. You can't use multiple tokens to avoid limits or share your token. Breaking these rules may lead to service termination.

Cancellation and Termination

  1. Any form of abuse directed towards JustPush customers, employees, members, officers, or any other customer — whether it's verbal, physical, written, or involves threats — will lead to the immediate termination of your account.
  2. Upon the cancellation of your service, all your data and content will be slated for removal. This data will be irretrievably deleted after 30 calendar days from the date of cancellation. Once this deletion process has occurred, your content cannot be restored.
  3. JustPush retains the authority to alter or discontinue your service at any given moment, for any reason, without prior notification.

Abusing anyone at any of our services leads to instant account closure. Canceling your service means your data gets deleted after 30 days, with no recovery option. We can end or change your service without warning.

Entire Agreement

This User Agreement encompasses the entire agreement and understanding between you and JustPush, and it overrides all previous agreements, both in writing and verbally. Any terms or conditions proposed by you in any form of communication that are additional to or differ from those in this User Agreement are considered null and void. You acknowledge and agree that your acceptance of the terms and conditions in this User Agreement is not based on any representations, whether spoken or written, made by JustPush that are not expressly included in this User Agreement.

This agreement is the complete deal between you and us, cancelling any previous arrangements. Any changes you propose won't apply. Your acceptance is based only on what's stated in this document, ignoring any outside promises or statements from us.

Severability

In the event that any part of this User Agreement is found to be invalid or unenforceable for any reason and to any extent, this shall not affect the validity and enforceability of the rest of the User Agreement. The rest of the provisions shall remain in full effect, and the application of the affected provision will be enforced as far as the law allows.

Simplified

If any part of this agreement is deemed invalid or can't be enforced, the rest still stands. The agreement remains effective, and only the problematic part is adjusted or ignored, as the law permits.

Changes to the User Agreement

JustPush reserves the right to update and change the User Agreement from time to time without notice and at its sole discretion.

Any new features or tools which are added to the current Service shall be also subject to the Terms of Service. Continued use of the Service after any such changes shall constitute your consent to such changes.

JustPush reserves the right to update and change the User Agreement by posting updates and changes to the Service website. You are advised to check the Terms of Service from time to time for any updates or changes that may impact you.

We can change this agreement whenever they want, without telling you. New features added to the service will also follow these terms. If you keep using the service after changes are made, it means you agree to them. You can always check the latest version of the agreement on their website. It's a good idea to look at the terms now and then to stay updated

Violation

Violation of any of the terms will result in the termination of your Account. You agree to use the Service at your own risk.

Governing Law and Disputes

This User Agreement shall be interpreted and enforced in line with the laws of the Netherlands. Any disputes, conflicts, or claims that arise from or relate to this User Agreement, including its formation, validity, binding effect, interpretation, performance, breach or termination, shall be exclusively subject to the jurisdiction of the competent courts of the Netherlands.
